Chính phủ cho rằng cần xác định quyền lập hiến là thể hiện cao nhất
chủ quyền nhân dân, gồm quyền sáng kiến lập hiến, quyền tham gia góp ý
trong quá trình dự thảo HP và cuối cùng là quyền biểu quyết thông qua
trưng cầu dân ý (*).
Chính vì thế Chúng Ta hãy đồng lòng:
1. Công khai gặp nhau nơi công cộng để trao đổi, trình bày ý kiến của mình về Hiến pháp cho một nước Việt Nam Dân Chủ.
2. Công khai bày tỏ chính kiến của mình về nội dung của Hiến pháp
trên mọi diễn đàn điện tử bằng những bài viết, phát biểu tại những nơi
công cộng bằng những bảng cầm tay, hàng chữ trên áo... Đó là quyền sáng
kiến lập hiến, quyền tham gia góp ý Hiến pháp mà chính phủ đã đề cập.
3. Công khai xuống đường phổ biến những tài liệu góp ý tích cực và
xây dựng về nội dung Hiến pháp để đồng bào chúng ta có những góc nhìn đa
dạng, nhằm có một quyết định sáng suốt và độc lập đối với Hiến pháp của
quốc gia.
4. Từ chối, bất hợp tác mọi hành vi cưỡng ép ký nhận những văn bản
liên quan đến Hiến pháp mà chúng ta không đồng ý và xem đó là những vi
phạm tư cách chủ thể về quyền lập hiến của người dân.
5. Công bố cho dư luận và chính phủ biết rõ mọi đe dọa, sách nhiễu
đối với cá nhân và gia đình trong tiến trình thể hiện quyền lập hiến của
mình.
Đối với chính phủ, chúng tôi, với nghĩa vụ đóng thuế để chính phủ có
thể hoạt động và vận hành những sinh hoạt của quốc gia, trong vai trò
của những người làm chủ đất nước và chủ thể của quyền lập hiến, yêu cầu
chính phủ:
1. Đăng tải mọi ý kiến độc lập của cá nhân, tập hợp quần chúng về
Hiến Pháp - điển hình là Lời Tuyên Bố của các Công Dân Tự Do, Thư của
Hội đồng Giám mục Việt Nam gửi Ủy ban Dự thảo sửa đổi Hiến pháp năm 1992
nhận định và góp ý sửa đổi Hiến pháp, Kiến Nghị 72 về Sửa đổi Hiến pháp
trên các kênh thông tin được vận hành bởi tiền thuế của nhân dân.
2. Thành lập một ủy ban độc lập để soạn thảo Hiến pháp và thu nhận ý
kiến của nhân dân. Tính độc lập được thể hiện bằng việc bao gồm nhiều
thành phần quần chúng trong ủy ban và không có quá bán đảng viên của
đảng cộng sản là thành viên của ủy ban.
3. Chấm dứt việc đến từng nhà dân ép ký tên vào kiến nghị trong đó chỉ có hai lựa chọn là đồng ý hoàn toàn và đồng ý kèm góp ý.
4. Ra văn bản nghiêm cấm và nghiêm trị mọi phát biểu, hành vi đe dọa
nhân dân khi thể hiện ý kiến độc lập của mình về Hiến pháp.
5. Tổ chức Trưng Cầu Dân Ý với sự giám sát của Liên Hiệp Quốc mà Việt
Nam là một thành viên, để có thể đảm bảo tính trung thực và khách quan
của cuộc Trưng Cầu Dân Ý.

Constituent Power Must Belong to the People
The Government of Vietnam has suggested that constituent power is the
perfect demonstration of popular sovereignty, which includes the right
to propose constitutional initiatives, the right to voice opinions
during the constitution drafting process, and, finally, the right to
vote via referendum. (*)
Therefore, together let us:
1. openly meet in public sites to voice and to share our opinions on the Constitution of a democratic Vietnam;
2. openly express our political views on the new constitution on
every e-forum by writing articles, by speaking in public spaces, by
holding placards and signs, by wearing campaign shirts, etc. Such is
exercising the right to propose constitutional initiative and the right
to contribute opinions – the rights that the Government has already
referred to.
3. freely go down the streets to disseminate positive and
constructive opinions on the Constitution, so that our compatriots will
adopt diverse viewpoints, thereby be able to make sensible and
independent decisions on the Constitution of the nation.
4. refuse to cooperate with any act coercing us into signing
documents related to the new constitution that we do not agree with and
consider to be violations of people’s right to constitutional making.
5. notify the public and the Government of all intimidation and
harassment against us and our family members during the time when we are
exercising our constitutional rights.
To the Government, We, as tax-payers who enable the Government to
operate and regulate the nation’s political life, as the owner of the
nation, and as the holder of constituent power, request You to:
1. publicize all opinions held by individuals and groups on the
Constitution, most notably the Declaration of Free Citizens, the Letter
of Observations and Propositions from the Committee of Vietnamese
Catholic Bishops to the Committee of the 1992 Constitutional Amendment,
and the Petition 72 on constitutional amendment, on all mass media
inherently surviving on people’s taxes.
2. establish an independent committee to draft the Constitution and
to collect citizens’ opinions hereof. Its independence shall be
characterized by the inclusion of non-communists and the presence of the
communists being restricted to half of its membership.
3. stop going from door to door, forcing people to sign on the
constitutional amendment draft which provides only two options of
“totally agree” and “agree to particular points”.
4. strictly ban and punish any statement or act that aims to
intimidate those who wish to voice their independent viewpoint of the
new constitution.
5. conduct referendum(s) under the supervision of the United Nations,
of which Vietnam is a full member, so as to guarantee the integrity and
objectivity of the referendum(s).
